It seems as though an eager Wii pirate by the name of James Burt from Queensland, Australia was caught by Nintendo. Burt apparently pirated and uploaded illegal copies of Nintendo's New Super Mario Bros. Wii ahead of the game's AU release date. Nintendo found this guy, took him to court and prosecuted. EEDAR analyst Jesse Divnich agrees with Nintendo of America CEO Reggie Fils-Aime: New Super Mario Bros. Wii is going to be one of the best-selling games of 2009 (via IndustryGamers). While Divnich concedes that in the short run Xbox 360 copies of Call of Duty: Modern Warfare 2 will outperform New Super Mario Bros. Wii this holiday, lifetime sales of the platformer are expected to exceed 15 million worldwide.

Nintendo's Reggie Fils-Aime is sticking his neck right out and betting that New Super Mario Bros. Wii will outsell Activision's Modern Warfare 2 on one console platform this holiday season.
